Terms of Service

The Service measures how AI assistants (such as ChatGPT, Perplexity, Claude, Gemini and Grok) cite, name and describe a business, and helps improve it. Its outputs include scores, citation records, competitor and directory findings, tracked questions, content and video plans, and suggested replies to public conversations.

The Service is informational and analytical. The AI assistants are third-party systems we do not control. We do not guarantee any particular citation, ranking, mention, traffic, lead or business outcome, and AI outputs can be wrong or change without notice.

You must be at least 18 and able to enter a binding contract. You are responsible for the accuracy of what you give us, for activity under your login, and for keeping your credentials secure. You may only scan, track or submit a domain you own or are authorised to act for.

You agree not to misuse or disrupt the Service, probe or test its security without permission, scrape or systematically extract it beyond your own use, submit unlawful, infringing or misleading content, or use it to break the terms of any third-party platform, including the AI assistants and any site where you post.

You are solely responsible for anything you publish based on our recommendations. Suggested replies to public conversations are drafts for a person to review and post from that person's own account, with the disclosure the platform provides. The Service never posts on your behalf, and neither may an agent you connect.

You may connect an AI agent or tool of your choice to the Service through our connection interface. A connected agent can read the data your login can read, and nothing else: it cannot start scans, generate content, change settings or post anywhere. Every call an agent makes is recorded with your identity, and you or your administrator can revoke an agent's access at any time; revocation takes effect on its next request.

You are responsible for the agents you connect, for what they do with the data they read, and for the terms of the agent's own provider.

Your plan, its price, its billing and any cancellation terms are agreed between you and 10xSearch. We do not charge you and hold no payment details of yours. If 10xSearch stops paying for the platform, your access may pause until it resumes; your data is kept in the meantime.

You keep every right to the facts about your business you give us and to the content you publish. The reports, plans and data the Service generates for you may be used for your own business purposes without restriction.

The Service itself, its methodology, software, models and text, is owned by 10XSearch Inc. and protected by law. You receive a limited, non-exclusive, non-transferable right to use it for your business while your access is active.

We may use aggregated, de-identified measurements across the Service to improve it and to describe it publicly. Nothing that identifies you or your business is published without your agreement.

The Service relies on third parties, including AI providers, search and data vendors, hosting, email delivery, payment processing and analytics. Their availability, accuracy and terms are outside our control, and we are not responsible for third-party systems or for the content of third-party sites.

The Service is provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that any score, measurement, estimate, plan or recommendation is accurate or will produce any result, or that any AI assistant will cite, name or describe you in any way.

The Service reports what third-party AI assistants and websites say and does not control them. Any decision you make on the strength of the Service, including anything you publish, post, claim, buy or change, is yours alone.

To the fullest extent permitted by law, 10XSearch Inc., its officers, directors, employees, contractors and suppliers will not be liable to you or to anyone claiming through you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, customers, rankings, citations, traffic, data or goodwill, or for the cost of substitute services, however caused and under any theory of liability, even if advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims of every kind relating to the Service, taken together, will not exceed the amounts you paid to 10XSearch Inc. for the Service in the three months before the event giving rise to the claim, or one hundred US dollars if you paid nothing. This cap is an essential part of the bargain and applies even if a remedy fails of its essential purpose.

We have no liability for: the content, accuracy or availability of any AI assistant, search engine, directory, forum or other third-party site or service; anything you or a connected agent publish, post or send; suspension or termination under these Terms; loss of data beyond restoring from our routine backups; or anything outside our reasonable control, including outages, attacks, changes by third-party providers, or acts of authorities.

Some jurisdictions do not allow certain exclusions or limits, in which case these apply to the fullest extent the law allows, and nothing here excludes liability that the law does not permit to be excluded.

You will defend, indemnify and hold harmless 10XSearch Inc. and its officers, directors, employees, contractors and suppliers from any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising from or relating to: your use of the Service; anything you or a connected agent publish, post, send or claim; your breach of these Terms or of the law; your dispute with any customer, competitor, platform or third party; or any domain or content you submitted without the right to do so.

You may stop using the Service at any time and may ask for your account to be paused or deleted. We may suspend or end access for a breach of these Terms, to protect the Service or other users, or where the law requires. Provisions that by their nature should survive termination survive it.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Any dispute that cannot be settled by talking to us first will be brought exclusively in the state and federal courts located in Colorado, and you consent to their jurisdiction. Any claim must be brought within one year of the event giving rise to it. Either side may seek injunctive relief in any court to protect its intellectual property or confidential information. To the extent the law allows, each side waives any right to a jury trial and to take part in a class or representative action.

We may update these Terms. Material changes are shown by the date above and, where appropriate, by notice to your account email. Continued use after a change takes effect is acceptance of it.
